Agreement
These terms apply when you use Mulching Knoxville (this website). By submitting a quote request you accept them. If you do not agree, please do not use the site.
What this service is
Mulching Knoxville is a free matching service for property owners. We are not a forestry mulching or land clearing contractor and we do not perform the work ourselves — we connect you with independent local crews who quote your property directly.
Our role begins and ends with passing your request to contractors who work in your area. Any work, agreement, schedule, price or payment is strictly between you and the contractor you choose to deal with.
What we do not do
To be explicit, we do not:
- Perform land clearing, forestry mulching, brush clearing or lot clearing work.
- Employ, supervise, direct or control any contractor.
- Act as an agent of any contractor, or of you.
- Guarantee, warrant or insure any contractor's work, pricing, conduct, licensing or insurance.
- Guarantee that any contractor will contact you, quote your property, or be available in your timeframe.
- Take payment from property owners or handle payment between you and a contractor.
- Provide legal, engineering, surveying, environmental or regulatory advice.
Information on this site
The service descriptions, cost factors and answers on this site are general information about land clearing work. They are not advice about your specific property, and they are not a quote or an offer.
Permit, drainage, floodplain, wetland and property-line requirements differ by county, by municipality and by parcel, and they change. Where we point you at a local office, that is a starting point, not a determination about your land. Verifying what applies to your property is your responsibility.
Your responsibilities
When you use this site you agree that:
- You are at least 18 years old.
- The information you submit is accurate, and you either own the property described or are authorised to seek quotes for it.
- You consent to be contacted about your request by phone, text and email by us and by the contractors we pass it to.
- You will carry out your own checks — insurance, scope, references, price — before hiring anyone.
- You will not use the site to submit false, abusive, automated or spam requests, or to scrape, copy or resell its content.
Disputes with contractors
If something goes wrong with a contractor, your recourse is against that contractor. We are not a party to your agreement with them and cannot resolve, arbitrate or compensate for a dispute over their work.
We do want to know about it. Feedback about a contractor's conduct directly affects whether we keep sending them requests.
No warranty
This site and the matching service are provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted or error-free, or that any request will result in contact, a quote, or completed work.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, property damage or costs arising from work performed or not performed by a contractor, whether or not you were introduced to them through this site.
Because you pay us nothing, and to the fullest extent permitted by law, our total aggregate liability arising out of or relating to the site or the service is limited to one hundred US dollars (USD $100).
Nothing in these terms excludes liability that cannot lawfully be excluded.
Intellectual property
The content, layout and design of this site are owned by Mulching Knoxville and may not be copied, republished or used to build a competing service without written permission.
Changes and availability
We may change, suspend or discontinue any part of this site at any time, and we may update these terms. Updates are effective when posted here, and the date at the top will change.
Governing law
These terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws rules. Any dispute relating to these terms or the site will be brought in the state or federal courts located in Knox County, Tennessee.
